There is no equal to testifying in person. Face to face communication combined with active listening are two of the expert’s most powerful tools. Further, personal testimony gives the testifier the opportunity to read the body language of both the other side and the finder of fact. Important indications about the matter can come from observing the interaction between the parties and their counsel including sidebar activities. Sometimes it is just sensing the “presence” of a member of the other side’s team that will give an important clue regarding case progress.
There are times when scheduling conflicts, a short hearing length, the lack of matter complexity or cost make in person testimony unattractive. Courts, mediators and FINRA Arbitration accept video conference testimony. This is often accomplished through the use of electronic applications such as FaceTime, Skype, or Hangouts. Some facilities with older video conference equipment require specialized transmission facilities, which are also available.
